This document governs the use of cantare.com.ro and quotation requests sent to DATA SPEED SRL. Mandatory Romanian and European Union law, especially consumer-protection rules, prevails in all circumstances.

This information is made directly, permanently and freely available in accordance with Romanian Law no. 365/2002 on electronic commerce.
2. Scope and definitions
The website primarily serves professionals seeking weighing equipment, but consumers may also use it. “Consumer” means a natural person acting outside their trade, business, craft or profession. Statutory consumer rights do not automatically apply to business-to-business relationships.
3. Nature of the website
The website is a presentation catalogue and communication channel, not an online store. It does not accept online payment or provide a button that directly creates an obligation to pay. Sending a quotation request, selecting products for a request or contacting DATA SPEED is not a firm order and does not automatically conclude a contract.
4. Product information
Descriptions, photographs and specifications support preliminary selection. Manufacturers may alter models and documentation, and images may show optional accessories. Capacity, accuracy, compatibility, approvals, legal metrology requirements, accessories and all essential characteristics must be confirmed for the quoted configuration. The accepted quotation, contract and documentation for the supplied product prevail if information differs. Nothing excludes liability imposed by law for misleading or inaccurate information.
5. Quotations and contract formation
DATA SPEED may request application, environment, capacity, integration, installation or metrology details before issuing a quotation. The quotation may specify configuration, price and currency, VAT, delivery or installation costs, payment, estimated delivery, validity, warranty and included services.
A contract is concluded only in the time and manner stated in the quotation, normally through unambiguous acceptance, DATA SPEED's order confirmation or a signed agreement. An automated receipt only confirms that the message arrived.
6. Prices, payment and delivery
The applicable price is the price in the accepted quotation. VAT and foreseeable additional costs will be identified as required. Payment, invoicing, advance payment, delivery, transfer of risk, installation, commissioning, training and after-sales services are governed by the accepted quotation or contract.
7. Legal metrology and site conditions
The client must describe the intended use and provide suitable installation conditions. Where legal metrological control applies, the quotation will identify included documents or operations. Merely listing a product does not state that every configuration is suitable for every regulated use.
8. Warranty, conformity and complaints
Any commercial warranty is described in the quotation or product documents and does not restrict mandatory consumer conformity rights. Romanian Emergency Ordinance no. 140/2021 and Government Ordinance no. 21/1992 apply to consumer sales where relevant. Complaints may be sent to office@cantare.com.ro with supporting details; technical inspection may be required before the applicable remedy is established.
9. Consumer withdrawal
If a distance contract is later concluded with a consumer, Romanian Emergency Ordinance no. 34/2014 governs pre-contract information and withdrawal. Where granted by law, the ordinary withdrawal period is 14 days. Statutory exceptions may include clearly personalised or made-to-order goods and fully performed services where all legal conditions are met. No exception applies unless the specific circumstances meet the law and the consumer was properly informed. Business cancellations and returns are governed by the accepted quotation or contract.
10. Acceptable use and intellectual property
Users must not provide false information, introduce malicious code, attempt unauthorised access, disrupt availability, scrape content abusively or infringe third-party rights. Original site materials belong to DATA SPEED or are lawfully used. Manufacturer trademarks and documentation belong to their owners. Commercial republication or systematic exploitation requires the relevant owner's consent, subject to statutory exceptions.
11. Availability and liability
DATA SPEED takes reasonable steps to keep the website secure and available, but maintenance and events outside reasonable control may interrupt it. To the extent permitted by law, DATA SPEED is not liable for loss caused exclusively by website misuse, inaccurate user data or external unavailability. Nothing excludes mandatory liability, consumer rights, fraud, wilful misconduct or gross negligence. Any specific B2B limitation must be contained in accepted commercial documents.
12. External links, privacy and cookies
External links are provided for convenience and do not imply control of third-party content. Personal data is covered by the Privacy policy, and device storage by the Cookie policy.
13. Complaints and disputes
We encourage direct, amicable resolution through the contact details above. Consumers may contact the Romanian National Authority for Consumer Protection (ANPC) and use its Alternative Dispute Resolution (SAL) procedure under Government Ordinance no. 38/2015. This does not restrict access to competent courts.
14. Governing law and updates
Romanian law governs these terms. Mandatory jurisdiction rules protect consumers. If one term is unenforceable, the remainder continues to apply as far as legally possible. Updated terms apply to use after publication and do not retroactively amend concluded contracts.

The framework includes the Romanian Civil Code, Law no. 365/2002, Emergency Ordinance no. 34/2014, Government Ordinance no. 21/1992, Law no. 193/2000, Law no. 363/2007, Emergency Ordinance no. 140/2021 and Government Ordinance no. 38/2015, in their applicable versions.
